POLICY TERMS AND CONDITIONS

 
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ORDERING GOODS FROM HAIRPLUS. 
 
The terms and conditions below form the contract between HAIRPLUS and the buyer. Your order of goods is confirmation of your acceptance and agreement with these terms and conditions and to be legally bound by them. HAIRPLUS is not obliged to accept your offer to purchase goods.
 
 
INTERPRETATION
 
'You' and 'Buyer' means the person(s) organisation or company that buys the goods from us and ‘Your' shall be interpreted accordingly.
  • ‘HAIRPLUS' shall mean 'HAIRPLUS.CO.NZ LIMITED' and/or its parent  company. 
  • 'Us' and 'We' both mean 'HAIRPLUS' and 'our' shall be interpreted accordingly. 
  • The 'Terms and Conditions' forming the policy detailed herein shall be governed by New Zealand law and any disputes shall be settled in accordance with New Zealand law.
  • 'Goods' and 'Products' shall mean any goods that HAIRPLUS supplies under the terms and conditions of contract detailed herein.
  • 'Contract' means any contract between you and us, for the sale and purchase of goods which incorporates these terms and conditions.
  • 'Website' shall mean http://www.hairplus.co.nz
  • 'Day' shall mean working or business day and days shall be interpreted accordingly.
  • ‘Buyer’ shall mean the person(s), organisation or Company that buys goods from  HAIRPLUS.
 NOTE
 
1.         Reference to any statute or statutory provision refers to its most recent version
2.         Reference to the singular includes the plural and vice versa
3.         Headings are used only for convenience
 
 
DESCRIPTION OF GOODS
 
HAIRPLUS takes care to accurately describe and display products and colours on our website. However, colours and products displayed on our website may look different to the actual product. 
 
Different manufacturers and suppliers have different colour descriptions and the ''same'' product and colour from suppliers may be slightly different. Hair Extensions, Wigs and Hairpieces have styling flexibility and as a result the supplied Extensions, Wigs or hairpiece may appear different depending on how it is styled.
 
HAIRPLUS will endeavor to accurately describe and portray goods but takes no responsibility for errors. Pictures, descriptions, specifications or advertising will not form part of the contract.  If the goods requested are not available we will provide substitutes. 
 
If you are not happy with the substitute goods we will accept the return of goods. Reference should be made to our Returns and Exchange Policy below.
 
 
SHIPPING & DELIVERY

Goods are shipped out within 1 (one) day of payment receipt subject to product availability and Credit Card Verification.  Allow 48 hours for other payment options such as Bank deposit or Internet banking.  Saturday delivery is by special request and will require special payment.  Goods will be delivered by post or courier to the address provided on the order form.  Any delivery date given by us will be an estimate and we will not be liable for any costs, damages, charges or other expenses caused by late delivery.  If the goods can not be delivered or you will not accept delivery for whatever reason and:-

 
 
1.         All risk in the goods will pass to you
2.         The goods will be deemed to have been delivered
3.         We may store the goods until you are able to take delivery at your cost.
 
HAIRPLUS will not be liable for any proven non delivery to you.  Our liability for non delivery of goods is limited to providing you with details of the shipment.  We are not responsible for loss or damage to goods that are delivered to an incorrect address.  HAIRPLUS will not deliver to P O Box or any address which we deem suspicious. We ship our goods by post or Courier service within New Zealand.  Should you feel that your goods do not arrive in good condition, please feel free to contact us at customercare@hairplus.co.nz.  HAIRPLUS will be deemed to have delivered the goods when passed to the post or courier service for delivery to you.
 
 
PRICE

All prices for goods are quoted in New Zealand Dollars and includes GST.  Prices are subject to change without notice.   The cost of delivery is shown and included in the final price.
 

PAYMENT
 
Payment may be made by any of the methods shown on our website.  Including Credit Card (Visa or MasterCard), Bank Deposit and Internet banking.
 
We will ship goods to you once your payment has been cleared to our account by our bankers. HAIRPLUS reserves the right to conduct a fraud check with our bankers prior to shipment of products.  HAIRPLUS may require additional information for large orders.
 
 
GIFT VOUCHERS
 
HAIRPLUS gift vouchers can be redeemed online @ www.hairplus.co.nz or at HAIRPLUS salon. HAIRPLUS Vouchers cannot be exchanged for cash. Gift vouchers have no value until validated upon issue. HAIRPLUS gift vouchers are only valid up to the date recorded as the expiry date. HAIRPLUS gift Vouchers will not be accepted if it has been altered in any way or form.
 

 HAIRPLUS REWARD POINTS

Purchase any product worth $10.00 or more and receive reward point which you can redeem for products or discounts on our website.

  • Reward points don’t apply to items already reduced/discounted.
  • Reward points are available to all retail and salon customers who do online transactions only.

How to use:

  • Simply make a purchase online.
  • After you select checkout, click on payment options.
  • Enter the points amount you want to use then click on apply. It is a simple as that.

    If you have problems redeeming you reward please contact us on 0800 424 775 and we will assist you to redeem your points.

 

RETURNS & EXCHANGES

HAIRPLUS is committed to providing and delivering top quality products and services to our customers.  We welcome the return and exchange of a product that has a manufacturer defect or damaged while in transit , providing the following conditions are met:  

·          You should notify us within 2 days of receipt by email at returns@hairplus.co.nz and include your order number as a reference.  Returns notified after 2 (Two) days of receipt cannot be accepted. 

·          Returned goods must be in their original packing and not damaged or altered in any way and the contents must be in their original resalable condition. We will not accept returned goods that have been opened or used for health and hygiene reasons. Especially hair extensions, wigs and hair pieces.

·          All products being returned must be shipped by courier with a tracking number. Returns of items that may be classed as hazardous goods require special handling. HAIRPLUS will not pay any return shipping cost, therefore shipping charges on exchanged or returned products are payable by you

·          Damaged items while in transit must be returned via Post Haste Courier (0800 106 828) in original packaging of the product and original courier package.  For lost items, you must notify us immediately if you haven’t received the package within 2 days by 5 pm.

·          A copy of the invoice must be included in all returns.

·          Your address and telephone number should be clearly and correctly stated in case we need to contact you. 

 We do not give a refund if you change your mind about a product.

 Refund policy:

We will credit your online shopping account for returned products and give you a coupon code for future purchase. Any credits to your HAIRPLUS online shopping account will be made within 7 working days of receiving the returned item and will be valid for one year.

We will not credit return shipping charges.

We will not give cash refunds for returned products.

Damaged items while in transit will be replaced within 14 – 21 days.

HAIRPLUS respects the privacy needs and concerns of our customers.  We will not obtain personally identifying information about you unless you choose to provide such information to us voluntarily, whether at our retail stores, on line, through mail order or other promotional activities.  Because our customers are of vital importance to us, we do not participate in bulk email solicitations which you have not consented to receiving (i.e., "spam").
 
Collection of your information; Instances where personally identifiable information may be gathered include registrations (for example, registration on our website) and at our stores or by mail order.  The types of personally identifying information we collect may include contact information (e.g., name, postal address, email address and phone number) and information about your hair care preferences, as well as other relevant information.  When you visit us online, we also may collect certain non-personally identifiable information, such as the type of browser you are using, the domain name of your Internet service provider, which of our pages you access, how long you spend on each page, and aggregate data about the number of visits you make and the products and services in which you are interested.  The information we learn from you during your visit helps us to improve our site, respond to your requests and customize your shopping experience with HAIRPLUS.  We use the personally identifiable information you provide to respond to any of your questions about our products and services.  Also, we employ other companies and individuals to perform functions on our behalf.  Examples include website hosting and development, fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, and processing credit card payments.  They have access to personal information needed only to perform their functions.  We require companies with whom we contract for outsourced services to keep data received from us confidential and to use it only for the purposes indicated. We may, from time to time, supplement the information we collect with outside records to enhance our ability to serve you, to tailor our content to you, and to offer you opportunities to purchase products or services that we believe may be of interest to you.  As required by law we may release personally identifying information when we believe release is appropriate to comply with law or legal process (e.g. in response to a court order) or to protect the rights or property of HAIRPLUS, our users, our partners or others.  This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.  In addition, in the event that all or substantially all of HAIRPLUS stock and/or assets are transferred or sold to another entity, we may transfer personally identifiable information to the acquiring entity. 
 
Protection of children’s personal information HAIRPLUS is concerned about protecting the safety and privacy of children.  We do not knowingly or specifically request or collect personally identifiable information from or about children and do not market specifically to children.  We do, however, sell children's products for purchase by adults. 
 
Cookies; Cookies are pieces of data your web browser stores on your hard drive. We use cookies so we can recognize you when you pay a repeat visit to our website.  Cookies let us personalize your shopping experience based on your preferences.  We also offer certain features that are only available through the use of a "cookie" and help us provide information which is targeted to your interests.  You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on our site and you will not be able to submit an order online.  Please be aware that if you link to another site from the HAIRPLUS website, you may encounter "cookies" or other similar devices placed by third parties.  We do not control the use of cookies by third parties. 
 
Security; Your privacy and security are very important to us, HAIRPLUS uses the best security available for on-line purchasing.  When you click the "Add to Shopping Cart" button, HAIRPLUS automatically checks to see that you have a secure connection.  HAIRPLUS uses Secure Sockets Layer (SSL), an encryption technology that works with the following browsers: Netscape Navigator, Microsoft Internet Explorer, and AOL (America Online).  If your browser does not support SSL, you will need to upgrade to a new version of Netscape Navigator, Internet Explorer, or AOL that does for on-line purchases.  Or, you may fax, mail or phone in your order.  As part of HAIRPLUS privacy and security practices, we do not store your credit card number in your membership file or order history.  We request you kindly provide us with your credit card number every time you make a secure transaction. 
 
Other legal notices; Our Privacy Policy applies only to HAIRPLUS and not to other companies' or organizations' sites to which we link or to which you otherwise provide your information. Accessing third party websites or sources requires you to leave our website.  We do not control those third party websites or any of the content contained therein and you expressly acknowledge and agree that we are in no way responsible or liable for any of those third party websites, including, without limitation, their content, policies, failures, promotions, products, services on or actions of those websites and/or any damages, losses, failures or problems caused by, related to or arising from those websites.  HAIRPLUS encourages you to review all policies, rules, terms and regulations, including the privacy policies, of each website that you visit.  We may change this Privacy Policy from time to time based on your comment, changes in the law and our need to accurately reflect our data collection and disclosure practices.  If you are concerned about how your information is used, please check our website periodically to review our current Privacy Policy.  Also you’re continued viewing of or use of our website and your continued transaction of business with HAIRPLUS following the posting of any changes to this Privacy Policy will signify your assent to any such changes or amendments.  This Privacy Policy is not intended to and does not create any contractual or other legal rights in or on behalf of any party.  HAIRPLUS is committed to treating your personal information in a confidential manner.  We have put in place appropriate physical, electronic, and managerial procedures to safeguard and maintain data security, and correctly use the information we collect.  If you have any questions about our Privacy Policy, please email us at: customercare@hairplus.co.nz  HAIRPLUS reserves the right to change this Privacy Policy at any time.
 
 
GOODS AND SERVICES TAX (GST)

HAIRPLUS is required by law to charge GST on all purchases made in New Zealand at a current rate of 12.5%.
 
 
FORCE MAJEURE
 
If we are unable to carry out our business due to circumstances beyond our control we may reduce the volume of goods shipped, cancel delivery, or cancel the contract.  Such circumstances include acts of God, Government actions, war, embargo, national emergency, fire, explosion, acts of terror, lock outs, flood, fire, epidemic etc.  If the circumstances in question continue for a continuous period of more than 10 days you may give us written notice to cancel the contract.


LIABILITY
 
Due to the lack of control we have over application and operation procedures for the use of glue, glue guns and other application tools, HAIRPLUS cannot accept any responsibility whatsoever for any damage or injury caused to users of the products.

HAIRPLUS shall not be liable for any loss or profits, or any consequential, indirect or special loss, or damage, or loss of any kind, arising directly or indirectly from any breach of HAIRPLUS obligations under this contract or in tort.  Where HAIRPLUS is liable to the buyer, the maximum cost of any liability shall not exceed the value of the goods, products or services provided to the buyer.  HAIRPLUS accept no responsibility for the actions of the buyer or the buyer’s wrongful use of goods purchased from HAIRPLUS.  We do not control, endorse or assume responsibility for any product, brand, method, treatment, information or services displayed on the website in any way.
 
 
NON WAIVER
 
Failure by HAIRPLUS to enforce any of the terms and conditions shall not be deemed to be a waiver of any of the rights or obligations HAIRPLUS has under the contract. 
 
 
DISCLAIMER
 
Product descriptions, typographic, pricing and photographic errors are unintentional and subject to correction.  We regret, but are not liable for these errors.
 
 
WARRANTY
 

HAIRPLUS supplies certain items with a warranty against failure.  As warranty conditions and terms vary for different manufacturers and items we request you refer to the conditions attached with each purchase.

WEEKLY POMOTION DOES NOT APPLY TO DISCOUNTED ITEMS AND IS SUBJECT TO AVAILABILITY
